1. Products
All products are subject to availability. Actual wood stains or paint colors may vary from what you see in your computer or product materials. In addition, the natural characteristics of wood lend themselves to color variation, and this is also true when finish is applied. Product information, availability, prices, and/or specifications are subject to change without notice.
2. Customer Responsibilities
KITCHEN WHOLESALERS.CA is not responsible for any inaccurate items, model numbers or measurements being provided by the Customer. KITCHEN WHOLESALERS.CA is not aware of the accuracy and level of the Customer’s floors and walls in their home, so consequently it is the Customer’s responsibility to level all products from their order once they receive the cabinets that may create uneven doors or other items that may be out of alignment due to improper leveling.
3. Accuracy
While KITCHEN WHOLESALERS.CA uses reasonable efforts to include accurate and up-to-date information in its Website and its product materials, KITCHEN WHOLESALERS.CA makes no warranties or representations as to the accuracy of the information. KITCHEN WHOLESALERS.CA assumes no liability or responsibility for any errors or omissions in the content of its Website and its product materials. If a product is quoted by a KITCHEN WHOLESALERS.CA associate at an incorrect price, KITCHEN WHOLESALERS.CA shall have the right to refuse or cancel any order. If your order is canceled by KITCHEN WHOLESALERS.CA, we shall issue a credit to your credit card in the full amount of your deposit.
4. Payment
A 50% deposit of the purchase price is required at the time of purchase. Your order will not be processed until we receive your deposit. Your order will not be released for delivery until it is paid in full.
5. Order Acceptance & Cancellations
Verbal authorization for us to charge your credit card constitutes the immediate acceptance of this order by the Customer, and the Customer hereinafter agrees to be bound by the terms and conditions of this Agreement. A complete order or separate items may be cancelled within 48 hours at no charge. After 48 hours, there will be a 25% restocking and handling fee applied to the customer’s account. The customer has to contact KITCHEN WHOLESALERS.CA via email in order to cancel an order. To confirm that an order has been canceled, KITCHEN WHOLESALERS.CA will email or fax a cancellation notice to the customer’s attention, only then will the cancellation be in effect.
6. Return Policy
It is the customer’s responsibility to properly repackage all items to be returned as well as to cover any freight charges. There will be a 25% restocking charge. Returns cannot be made after the item(s) has been assembled or installed. Assembled cabinets are non-refundable. Returns cannot be made after 30 days of receiving the order.
7. Shipping, Handling, and Delivery
Our office will contact you in order to set up a delivery date. When you receive your order, inspect your cabinets for damage or defects. If any pieces are damaged, you must notify the store within 48 hours. Items carry the natural characteristics of the wood and are manufactured in the way in which most manufacturers finish their products. Wood products do vary in grain and may have natural distressing. Any statements made about delivery times are estimated and not guaranteed. KITCHEN WHOLESALERS.CA cannot be held responsible for any delays in delivery of your furniture for any reason.
Shipping times will vary per manufacturer. Title to the materials shall pass from the Seller to the Buyer upon delivery thereof to Buyer or his agent and thereafter shall be Buyer’s risk. Claims for shortages, breakage or for any nonconformance, with the terms and conditions of the order shall be noted on the Seller’s delivery receipt by the Buyer at the time of delivery; otherwise, the Seller shall not be responsible for any such claims. If delivery is by common carrier, delivery by the Seller to the carrier at point of origin shall constitute delivery to the Buyer and thereafter the shipment shall be at Buyer’s risk, and claims for loss or damage must be filed by the Buyer against the carrier. Title to goods loaded onto Buyer’s conveyance at Seller’s warehouse passes to the Buyer at the Seller’s loading dock. If you cannot be present at the time of the scheduled delivery, please make arrangements to have a responsible representative present to fully inspect and accept the furniture on your behalf. The signature of your representative on the delivery receipt binds you with respect to all aspects of the acceptance of the delivery including the condition of the items delivered.
8. Delay in delivery or non-delivery in whole or in part by Seller shall not be a breach of the sale if performance is made impracticable by the occurrence of any one or more of the following contingencies, the non-occurrence of which is a basic assumption or which the agreement is made: (a) fires, floods, or other casualties; (b) wars, riots, civil commotion, embargoes, governmental regulations or martial law; (c) Seller’s inability to obtain necessary materials (finished or otherwise) from its usual sources of supply; (d) shortage of cars or trucks or delays in transit; (e) existing or future strikes or other labor troubles affecting production or shipment, whether involving employees of Seller or employees of others, and regardless of responsibility or fault on the part of the employer; and (f) other contingencies of manufacture or shipment, whether or not of a class or kind mentioned herein and not reasonably within Seller’s control.
9. Damages / Shortages / Claims
If concealed damage is discovered after the receipt of the merchandise, KITCHEN WHOLESALERS.CA must be notified within 2 days to enable us to replace parts or the damaged product at no cost to you. Replacement parts may be obtained by completing a Replacement Parts order Form. Original cabinets or parts may require return to KITCHEN WHOLESALERS.CA for credit. The Customer must e-mail or mail pictures to KITCHEN WHOLESALERS.CA clearly showing the nature of the defect.
